Zimmer Asks NexGen Knee Implant MDL Court to Compel Discovery in Defendant’s Bellwether Trial Selections

CHICAGO –– Zimmer has filed a motion to compel in the MDL docket for claims alleging injuries in connection with the implantation of the defendant’s NexGen knee device, saying that the plaintiffs have failed to provide discovery in cases Zimmer picked as bellwether trial selections.

In the July 6 motion to compel, the defendant told the U.S. District Court for the Northern District of Illinois that the plaintiffs’ failure to participate in discovery has “thwarted the Court’s ability to regularly hold trials in this MDL.”
