BIRMINGHAM, Ala. — An Alabama federal judge has dismissed without prejudice wrongful death claims brought against Wyeth Pharmaceuticals Inc. and Upsher-Smith Laboratories Inc. in an amiodarone case, ruling that the plaintiff failed to sufficiently allege causation.
In a Jan. 14 order, Chief Judge Karon O. Bowdre of the U.S. District Court for the Northern District of Alabama explained that Wyeth cannot be held liable for injuries caused by the generic equivalent of its name brand drug Cordarone. The judge further found that Upsher only had a duty to provide a Medication Guide for its drug to the prescribing doctor, …
