MINNEAPOLIS- A federal judge denied a motion to remand a proposed nationwide class action suit filed against the makers of Baycol stating that the damages would exceed the jurisdictional limit of $75,000. In re: Baycol Products Liability Litigation, MDL 1431 (D. Minn.).
The plaintiffs' complaint did not state a specific damage amount except that the damages would exceed $15,000. However, U.S. District Judge Michael J. Davis opined that the plaintiffs' alleged injuries warrant damages that would exceed the jurisdictional limit.
