KNOXVILLE, Tenn. — A Tennessee federal magistrate judge has denied a plaintiff’s motion to quash a subpoena that defense counsel intends to serve on a treating nurse in an Aredia case, finding it was filed in accordance with the scheduling order issued by the judge overseeing this case.

In a Dec. 11 order, Magistrate Judge C. Clifford Shirley Jr. of the U.S. District Court for the Eastern District of Tennessee further found the plaintiff waived her right to object to the subpoena because she did not object to the scheduling order, which was issued nearly a year ago.
