N.J. Judge Denies Ranbaxy Judgment on the Pleadings in Solodyn Case

TRENTON, N.J. — A New Jersey federal judge has denied Ranbaxy Pharmaceuticals Inc.’s (NSE: RANBAXY) motion for judgment on the pleadings in a Solodyn injury case, ruling that the exception to the rebuttable presumption of non-liability under Texas law is not federally preempted.

On Dec. 18, Judge Robert B. Kugler ruled that the U.S. Supreme Court's “narrow” ruling in Buckman Co. v. Plaintiff's Legal Comm. (531 U.S. 341, 121 S.Ct. 1012, 148 L.Ed.2d 854 [2001]) “is unstable ground on which to rest a finding of preemption.”
