Bard Denied Summary Judgment in G2 Vena Cava Filter Case

DETROIT — A Michigan federal judge has denied C.R. Bard Inc. (NYSE: BCR) summary judgment on claims brought in connection with its G2 vena cava filter, finding questions of fact as to whether the device fractures at an unreasonable rate and whether Bard adequately warned of this risk.

On Dec. 6, Senior Judge Arthur J. Tarnow of the U.S. District Court for the Eastern District of Michigan found the plaintiff’s expert testimony that defects in the device’s design contributed to or caused the filter to fracture creates a genuine issue of material fact.
