I-Flow Denied Summary Judgment on Failure-To-Warn Claim in Pain Pump Case

PHOENIX — An Arizona federal judge has denied I-Flow Corp. (NYSE: KMB) summary judgment on claims it failed to warn surgeons that use of its pain pump in the joint space could cause chondrolysis.

On Nov. 20, Judge David G. Campbell found the plaintiff proffered evidence that raises a question as to whether the manufacturer had sufficient information to prompt further testing before the pain pump was used for intra-articular purposes.

The judge also denied Breg Inc.’s motion for summary judgment on a claim that it should have warned about the regulatory status of its pain pump. At this point, …
