Federal Judge Remands Stryker Rejuvenate Case After Allowing New Non-Diverse Defendant

MIAMI — A federal judge who agreed that a Stryker (NYSE: SYK) Rejuvenate hip implant plaintiff could not prevail on strict liability claims against one alleged in-state distributor has nonetheless remanded the case to state court after allowing new claims against another non-diverse defendant.

Judge Cecilia M. Altonaga of the U.S. District Court for the Southern District of Florida said in granting Jamie Simon’s motion to amend and for remand Nov. 30 that the equities favor allowing Simon to bring in additional defendants.
