Arkansas Federal Judge Dismisses Claims Against Generic Reglan Makers

LITTLE ROCK, Ark. - An Arkansas federal judge has dismissed claims brought against the makers of generic Reglan, ruling that the claims are all premised on the manufacturers' alleged failure to warn and therefore are preempted pursuant to PLIVA v. Mensing. Fullington v. Pliva Inc., No. 4:10-236 (E.D. Ark.).
On Dec. 12, Judge J. Leon Holmes of the U.S. District Court for the Eastern District of Arkansas found that the plaintiff failed to adequately plead claims of manufacturing and design defect. However, he allowed the plaintiff an opportunity to amend her complaint.
