Ky. Judge Denies Motion for Expedited Hearing on Remand of DePuy ASR Case

LOUISVILLE, Ky. - A federal judge has denied a Kentucky plaintiff's motion for an expedited hearing on remanding her DePuy ASR implant case to state court and, instead, has granted DePuy's request to stay the action pending transfer to the MDL in the U.S. District Court for the Northern District of Ohio. Fox v. DePuy Orthopaedics, Inc., et al., No. 3:11-cv-387 (W.D. Ky.).

Judge Charles R. Simpson III of the Western District of Kentucky issued his order on Dec. 6 on motions by DePuy and plaintiff Joyce Fox.
