Reglan Plaintiff May Amend Complaint, Federal Judge Rules

CLEVELAND, Ohio - An Ohio federal judge has allowed a Reglan plaintiff to amend her complaint to add two additional drug makers as defendants and to add additional state law claims. Fulgenzi v. Wyeth Inc., No. 09-01767 (N.D. Ohio).

On Nov. 29, Judge Sara Lioi of the U.S. District Court for the Northern District of Ohio ruled that the plaintiff did not show "undue delay" in moving for leave to amend her complaint. The judge further ruled that because this case is still in the early stages of litigation, the defendants would not be prejudiced by the amended complaint.
