Pacemaker Injury Suit Remanded to State Court

TRENTON, N.J. - A magistrate judge's recommendation that a pacemaker injury suit be remanded to state court for lack of diversity jurisdiction has been adopted by a New Jersey federal judge. Reuter v. Medtronics Inc., No. 10-3019 (D. N.J.).

On Nov. 23, Judge P. Kevin Castel of the U.S. District Court for the District of New Jersey adopted Magistrate Judge Mark Falk's reasoning that the treating physician, who is from the same state as plaintiffs, was not fraudulently joined because the claims against him are related to the claims against the pacemaker manufacturers.
