Judge Dismisses Sprint Quattro Lead Suit Against Medtronic

CLARKSBURG, W. Va. - A West Virginia federal judge has dismissed claims of negligence per se, manufacturing defect and breach of express warranties brought against the manufacturer of the Sprint Quattro Lead on the basis that they were inadequately pled. Bishoff v. Medtronic Inc., No. 09-171 (N.D. W. Va.).

Judge Irene M. Keeley of the U.S. District Court for the Northern District of West Virginia further ruled that the Medical Device Amendments to the Food, Drug and Cosmetics Act preempts plaintiff's claim for breach of implied warranty of fitness.
