Avandia Injury Case Remanded to State Court

BENTON, Ill. - An Illinois federal judge has remanded an Avandia personal injury action, ruling that there is a lack of complete diversity of citizenship. Colon, et al. v. SmithKline Beecham Corp., No. 09-1073 (S.D. Ill.).

In a Jan. 5 order, Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois held that the now-dissolved predecessor of the defendant, GlaxoSmithKline, is incorporated in Pennsylvania and four of the plaintiffs are Pennsylvania citizens. In Pennsylvania, a dissolved corporation may be sued, the judge explained.
