Abbott Labs Prevails in Ill. Federal Baby Formula Heavy Metals Case

CHICAGO — An Illinois federal judge has awarded Abbott Laboratories summary judgment in a lawsuit accusing it of failing to disclose that its Similac baby formula was contaminated with heavy metals, finding they failed to establish damages.

In a Feb. 26 order, Judge Matthew Kennelly of the U.S. District Court for the Northern District of Illinois found the plaintiffs did not present evidence that they actually overpaid for the product.
