Ariz. Federal Judge Scraps Minor League Baseball Teams’ COVID-19 Coverage Action

PHOENIX — An Arizona federal judge has thrown out a COVID-19 coverage action filed by several minor league baseball teams, agreeing with the insurers that the claimed losses fall within the policy’s virus exclusion.

In a Nov. 13 order, Judge Douglas L. Rayes of the U.S. District Court for the District of Arizona rejected the teams’ argument that the insurers are estopped from enforcing the virus exclusion, explaining that general equitable estoppel is “not available to bring within the coverage of a policy risks not covered by its terms, or risks expressly excluded therefrom.”
