Pa. Judge Allows Philly Gastropub’s COVID-19 Coverage Action to Proceed

PHILADELPHIA — A Pennsylvania judge has rejected preliminary objections levied by Certain Underwriters at Lloyd’s, London to a restaurant’s COVID-19 business interruption coverage complaint, ruling that the plaintiff “has successfully pled to survive this stage of the proceedings.”

In an Oct. 26 two-page order, Judge Gary S. Glazer of the Philadelphia County Court of Common Pleas concluded that it would be “premature” to dismiss the claims filed by Taps & Bourbon on Terrace LLC. The judge added that “the law and facts are rapidly evolving in the area of COVID-19 related business losses.”
