PHOENIX — A group of Minor League Baseball teams are urging an Arizona federal judge to deny a motion to dismiss their COVID-19 business interruption coverage action, arguing that it cannot be presumed at this stage in the litigation that the policies’ virus exclusion applies to all of their losses.
In an Oct. 14 reply filed in the U.S. District Court for the District of Arizona, the teams contend that the issues involve factual questions that must be resolved against National Casualty Co., Scottsdale Indemnity Co. and Scottsdale Insurance Co. on their motion.
