Chicago Health Club Sues Affiliated FM for COVID-19 Coverage

CHICAGO — A Chicago health club has sued Affiliated FM Insurance Co. for business interruption losses it incurred when government closure orders issued in response to the COVID-19 pandemic forced it to temporarily cease operations.

In a complaint removed to the U.S. District Court for the Northern District of Illinois on Sept. 28, East Bank Club Venture LLC contends that its policy “explicitly acknowledges that the presence of communicable disease causes physical damage to property because it provides coverage for “cleanup, removal and disposal of communicable disease.”
