Miami Seafood Restaurant Says COVID-19, Closure Orders Caused Physical Loss of Property

MIAMI — A Miami oyster bar and seafood restaurant has sued Tokio Marine Specialty Insurance Co. for coverage of business interruption losses and expenses it incurred when it was forced to close in compliance with government orders issued in response to the COVID-19 pandemic.

In a Sept. 25 complaint filed in the U.S. District Court for the Southern District of Florida, Mignonette Miami LLC contends that coverage under the policy’s provisions for Business Income, Extra Expense and Civil Authority has been triggered, because the virus and related government closure orders caused “direct physical loss of and/or damage” to its insured …
