Appalachian Insurance Drops $1.6 Million Suit Against Century




NEW YORK - Appalachian Insurance Co. has voluntarily dismissed a $1.6 million lawsuit against Century Indemnity Co. in which it sought indemnity for a 2004 settlement of underlying asbestos injury claims. Appalachian Insurance Co. v. Century Indemnity Co., No. 08-6361 (S.D. N.Y.).

Appalachian filed its notice of dismissal on Sept. 24 in the U.S. District Court for the Southern District of New York.

Appalachian demanded payment from Century pursuant to two facultative reinsurance certificates issued by Century's predecessor, Insurance Company of North America. INA allegedly reinsured certain excess liability policies issued by Appalachian to Dresser Industries Inc. in the …
