Cedents Oppose Enstar’s Motion to Dismiss Intentional Interference, Breach of Contract Claims

LOS ANGELES — California Capital Insurance Co. (CIC) has opposed a motion to dismiss its lawsuit against Enstar (US) Inc., arguing it has adequately alleged Enstar and its affiliates directed their reinsurer subsidiary to deny CIC’s reinsurance claims.
In a Nov. 2 opposition filed in the U.S. District Court for the Central District of California, CIC further argues that Enstar (US) Inc. d/b/a Enstar Administrators, Cranmore (US) Inc., and Enstar Group Ltd.’s claim of protection under the agency privilege relies upon matters outside the complaint and therefore cannot be considered on a Rule 12(b)(6) motion.
