UTICA, N.Y. — A New York federal judge has refused to reconsider his denial of Century Indemnity Co.’s motion for summary judgment in a dispute over whether it breached two reinsurance certificates by refusing to pay Utica Mutual Insurance Co.’s defense costs.
In a Nov. 30 order, Judge David Hurd of the U.S. District Court for the Northern District of New York said he properly found Century had failed to meet its burden of showing that a previous arbitration award estopped Utica from litigating the meaning of the certificates’ language.
