Celanese Opposes Resolute’s Motion to Dismiss, Says Agent Acted for its ‘Sole Benefit’ in Delaying Payment

DALLAS — In opposing Resolute Management Corp.’s motion to dismiss claims asserted against it in an asbestos coverage action, Celanese Corp. argued that it has sufficiently alleged that Resolute’s delay in paying Celanese’s claims directly benefited Resolute and its affiliates by preventing payment of reinsurance funds owed for the losses.

In its Dec. 29 opposition filed in the U.S. District Court for the Northern District of Texas, Celanese maintained that Texas recognizes a cause of action for tortious interference against an agent such as Resolute when the agent acts for its sole benefit.
