Resolute Seeks Dismissal of Celanese’s Claims, Says It Did Not Act Outside Scope of Agency

DALLAS — Resolute Management Corp. has asked a Texas federal court to dismiss claims asserted against it by Celanese Corp. in an asbestos coverage action, arguing that it merely acted as an agent for OneBeacon America Insurance Co. and therefore cannot be held liable for wrongfully denying coverage to Celanese.

In its motion to dismiss filed in the U.S. District Court for the Northern District of Texas, Resolute says Celanese has failed to provide any facts supporting its “conclusory” allegation that Resolute acted outside the scope of its agency.
