ATLANTA — Canal Insurance Co. is urging a Georgia federal judge to remand an $11.3 million reinsurance fraud action, arguing that it has properly joined and served four defendants and the sole removing defendant has not proven that he is not a Georgia citizen.
In its Oct. 21 response to an order to show cause issued by the U.S. District Court for the Northern District of Georgia, Canal further maintains that the removing defendant has failed to present evidence of fraudulent joinder.
