FAA Does Not Authorize Transfer of Confirmation Proceedings to State Court, Judge Rules

HARTFORD, Conn. - A Connecticut federal judge has refused to transfer an arbitration confirmation proceeding to New York state court, ruling that neither the Federal Arbitration Act nor Connecticut arbitration law provides the court with such authority. Subway International B.V. v. Bletas, No. 10-1715 (D. Conn.).

Judge Peter C. Dorsey of the U.S. District Court for the District of Connecticut further ruled that although a parallel action is pending in the state court, the "first filed" rule does not apply because a parallel action is not pending in another federal court.
