Tenn. Supreme Court Denies Chance to Review $5 Million Verdict

KNOXVILLE, Tenn. -- The Tennessee Supreme Court has denied an application for permission to appeal a $5 million verdict in an asbestos and solvent exposure case. Hensley v. CSX Transporation Inc., No. E2007-00323-SC-R11-CV (Tenn. Sup. Ct.); Hensley v. CSX Transportation, No. 02 C 153 (Tenn. Cir. Ct., Hamilton Cty.).

The high court released the one-page order on Nov. 17, more than two years after the Hamilton County Circuit Court jury reached its verdict.

In September 2006, the jury awarded $5 million to a former electrician who claimed his dual exposure to asbestos and cleaning solvents caused asbestosis and brain damage. …
