EAST ST. LOUIS, Ill. -- A benzene plaintiff has sought remand of his claims back to Illinois state court, contending that the defendants' removal fails because the plaintiff's claims do not arise from toxic exposures at a federal enclave. Dennison, et al. v. Shell Oil Co., et al., No. 07-802 (S.D. Ill.).
In a Dec. 7 motion to remand filed in the U.S. District Court for the Southern District of Illinois, the plaintiff also contends that the case was improperly removed because the defendants violated the 30-day removal deadline.
