Court Excludes Experts; Allows Possibility of Substitutions in Future




LITTLE ROCK, Ark. -- A federal judge has granted a defense motion to exclude six plaintiff experts from testifying during a benzene trial, but noted that the plaintiffs will be permitted to file a motion to permit one of the experts to testify, provided it is 90 days before trial. Johnese, et al. v. Ashland Chemical Inc., et al., No. 06-001632 (E.D. Ark.).

On Oct. 31, Judge Garnett Thomas Eisele of the U.S. District Court of the Eastern District of Arkansas also found that a motion to quash depositions of the valid plaintiffs' experts was moot.
