KNOXVILLE, Tenn. -- Benzene plaintiffs who allege exposure occurred during forklift repair duties voluntarily dismissed Valspar Corp. without prejudice, according to a Dec. 22 order. McCarter, et al. v. Alcoa, et al., No. 06-00141 (E.D. Tenn.).
The notice of dismissal filed in the U.S. District Court for the Eastern District of Tennessee said the dismissal was pursuant to Fed. R. Civ. P. 41(a).
Robert and Sharon McCarter filed their benzene complaint early last year, alleging that Robert's work repairing forklifts exposed him to benzene-containing products. The McCarters claim that Robert developed aplastic anemia as a result of the work exposure. …
