Court Denies Motion to Reconsider Remand, Rejects Appeal Request

JACKSON, Miss. -- A federal court has denied a Mississippi couple's motion to review a remand order, saying that the denial of the remand motion did not constitute a 'final' order. Fowler, et al. v. First Chemical Corp., et al., No. 05-16 (S.D. Miss.).

Even if the order were appealable, the U.S. District Court for the Southern District of Mississippi said in the Aug. 21 decision that it would not have granted the motion to reconsider because the only basis offered by the plaintiffs were other conflicting court orders and such a ground does not constitute an 'obvious legal error.'
