Benzene Trial Pushed Back to Jan. 12; Motion to Compel Still Pending

LOS ANGELES -- A benzene trial set to begin last month was continued to Jan. 12, sources told HarrisMartin. O'Neill v. Union Pacific Railroad Co., et al., No. BC319682 (Calif. Super. Ct., Los Angeles Cty.).

Plaintiff Donald O'Neill claims that he has developed chronic myelogenous leukemia as a result of exposure to benzene while employed as a brakeman for Union Pacific. Filed in the California Superior Court for Los Angeles County, O'Neill claims were brought under the Federal Employer Liability Act.

The judge overseeing the case has yet to rule on O'Neill's motion seeking production of documents from Chevron.
