Louisiana Benzene Plaintiffs Move to Remand Case, Say Removal was Untimely

NEW ORLEANS –– Benzene plaintiffs have asked a Louisiana federal court to remand their claims, contending that the case was not timely removed and that they have adequately pled strict liability and negligence claims against the in-state defendant, according to a recent motion.
In a motion to remand filed Nov. 3 in the U.S. District Court for the Eastern District of Louisiana, the plaintiffs noted that the defendants removed the case nearly two years after it was originally filed in the Civil District Court for the Parish of Orleans.
