NEW ORLEANS –– A Louisiana federal court has allowed a benzene plaintiff’s maintenance and cure claims to proceed, ruling that it was too early in the litigation to assess the validity of the claims.
In the same Dec. 3 order, the U.S. District Court for the Eastern District of Louisiana did grant an unopposed motion to dismiss a number of future damages-related claims, but allowed a claim for future earnings to stand, reiterating the early stage of the proceedings.
