Michigan Parties Filed Dozens of In Limine Motions Ahead of December Benzene Trial




DETROIT –– Parties in a Michigan benzene lawsuit have filed dozens of in limine motions in anticipation of a Dec. 3 trial, with the plaintiffs requesting that the court determine that non-economic damages are not capped and that the defendant be precluded from referencing other cases in which plaintiff experts have testified.

For its part, Safety-Kleen attempts to bar evidence that Proposition 65 warnings constitute evidence of benzene content and references to the defendant’s size or financial condition. The motions were filed just prior to the U.S. District Court for the Eastern District of Michigan’s Oct. 28 deadline.
