Alabama Woman’s Benzene Claims Dismissed under Federal Employees’ Compensation Act

BIRMINGHAM, Ala. –– An Alabama federal court has dismissed benzene claims asserted against the Tennessee Valley Authority after concluding that they were barred by the Federal Employees’ Compensation Act.

The U.S. District Court for the Northern District of Alabama subsequently found that the plaintiff’s complaint failed to state a claim upon which relief could be granted, warranting dismissal with prejudice.

The lawsuit was filed by Cynthia Osborn on behalf of her deceased husband, Michael Osborn.
