NEW ORLEANS –– A Louisiana federal court has granted International Paint’s motion for summary judgment on negligence and strict product liability claims in a benzene case, finding that the plaintiffs had failed to present evidence that the causes of action accrued before the enactment of the Louisiana Products Liability Act.

In the Oct. 16 order, the U.S. District Court for the Eastern District of Louisiana rejected efforts made by the plaintiff to defeat the summary judgment motion by using cumulative exposure rates to prove the plaintiff’s daily exposure.
