La. Court Dismisses Fraud Claims Against Exxon, Allows for Leave to Amend

NEW ORLEANS -- A Louisiana federal court has granted a motion to dismiss made by ExxonMobil after finding that the plaintiffs had failed to plead state-law fraud claims with particularity, but allowed the plaintiffs 20 days to amend their complaint. Boutain, et al. v. Radiator Specialty, et al., No. 11-1907 (E.D. La.).

In the Dec. 8 opinion, the U.S. District Court for the Eastern District of Louisiana found that the plaintiff had failed to establish a relationship with ExxonMobil that would support the fraud-related claims.
