U.S. Says Feres Doctrine Bars Claims Filed in Georgia Federal Court

ATLANTA -- The United States of America has supported its motion to dismiss a Camp Lejeune lawsuit filed in Georgia federal court, contending that the claims fail under the well-established law that bars active members of the military to sue the U.S. Government. Bryant v. United States of America, No. 10-02741 (N.D. Ga.).

In the Jan. 18 reply brief filed in the U.S. District Court for the Northern District of Georgia, the U.S. says that multiple courts have dismissed similar actions based on the Feres doctrine and that the pending motion for a coordinated docket before the U.S. Judicial Panel …
