NEW ORLEANS -- A federal court overseeing a benzene case has granted a motion to strike an affidavit filed by Frank M. Parker III, noting that while the plaintiffs failed to oppose the motion in the required time, the motion appeared to have merit as well. Bunch, et al. v. Shell Oil Co., et al., No. 10-01226 (E.D. La.).

In its Nov. 19 order, the U.S. District Court for the Eastern District of Louisiana said that an opposition should have been filed with the court eight days prior to the hearing date. Since the hearing was set for Nov. 24 …
