NEW ORLEANS -- A federal court in Louisiana has issued an order detailing the rules under which Radiator Specialty may claim a document is privileged in a benzene case. Wagoner, et al. v. ExxonMobil Corp., et al., No. 09-07257 (E.D. La.).

In the Sept. 28 agreed protective order filed in the U.S. District Court for the Eastern District of Louisiana, the court said that the parties are permitted to challenge the confidential designation.
