1st Circuit Receives Documents in Appeal of Causation Testimony Decision

BOSTON -- The U.S. Court of Appeals for the 1st Circuit has received documentation relating to the plaintiffs appeal of a district court decision that struck general causation expert testimony on grounds that it was "at best a plausible hypothesis," according to the court's online docket. Milward, et al. v. Acuity Specialty Products, et al., No. 07-11944 (D. Mass.).

According to a certificate filed in the U.S. District Court for the District of Massachusetts, binders of hearing exhibits and powerpoint presentations were sent to the 1st Circuit on Oct. 5.

The plaintiffs filed their notice of appeal on Sept. 11.
