Summary Judgment for Warren Pumps Affirmed by Calif. Court

SAN FRANCISCO -- A summary judgment award entered in favor of asbestos defendant Warren Pumps LLC has been affirmed after a California appellate court found that the plaintiffs' allegations against the company lacked foundation. Holliday v. Warren Pumps, No. A118809 (Calif. Ct. App., 1st Dist., Div. 4).

In the Nov. 4 opinion, the First District Court of Appeal opined that testimony entered on behalf of the plaintiff -- including a declaration by industrial hygienist Kenneth Cohen -- was speculative and failed to sufficiently link the defendant's asbestos-containing product to the plaintiff's injury.
