CHARLESTON, W. Va. - A West Virginia Circuit Court was working within its discretion when it awarded an asbestos plaintiff a new trial after a jury ruled in favor of his employer and defendant in the case, Conrail Corp. That according to a Nov. 30 decision by the Supreme Court of Appeals, which affirmed the court's decision to set aside the verdict in favor of plaintiff Fred Lamphere after finding that the jury's decision had been issued in contrast to the clear weight of the evidence presented during trial.
