New Jersey Court Set to Decide 3rd Party Duty-of-Care Issue

TRENTON, N.J. -- Several groups have filed an amici curiae brief in support of ExxonMoboil's attempts to reverse a decision in which a New Jersey appellate court determined it did owe a duty of liability to a woman who allegedly developed mesothelioma after washing her husband's work clothes. Olivo v. ExxonMobil, Corp., et al., No. 58, 040 (N.J. Sup. Ct.).

In a recent brief filed in the New Jersey Supreme Court, the parties claim that no relationship exists between the plaintiff and the defendant, and that the court cannot impose a duty on a landowner.
