NEW YORK - A New York Supreme Court has denied summary judgment to two friction defendants in an asbestos claim after issuing an order allowing plaintiffs to depose two of the deceased plaintiff's co-workers. Lechner v. ACandS, Inc., et al., No. 002411/02 (N.Y. Sup. Ct., Nassau Cty.).

The Sept. 25 order from the Nassau County Supreme Court comes after defendants Ford Motor Co. and DaimlerChrysler Corp. said they missed the deposition of plaintiff Joseph Lechner because they had removed claims filed against them to the U.S. Bankruptcy Court for District of Delaware on grounds that they were related to the …
