N.Y. Court Rejects Shulton’s Efforts to Dismiss Cosmetic Talcum Powder Case on Jurisdiction Grounds

NEW YORK –– A New York trial court has refused to dismiss an asbestos cosmetic talcum powder case for lack of jurisdiction, finding that the defendant had sufficient contacts with New York during the time of the alleged exposure.

In the Oct. 19 order, the New York Supreme Court for New York County opined that the plaintiff had successfully demonstrated that Shulton, Inc. transacted business within New York, committed a tortious act of distributing asbestos-contaminated products within the state, and possessed headquarters situated within the state.
