N.Y. Court Rejects Efforts by Defendant in Asbestos Talc Action to Dismiss Claims on Jurisdiction Grounds

NEW YORK –– A New York state court has denied efforts by Neslemur Company to dismiss the asbestos cosmetic talcum powder claims asserted against the company on jurisdiction grounds, finding that it could assert specific personal jurisdiction over the company.

In the Feb. 28 order, the New York Supreme Court for New York County opined that the defendant had committed a tortious act within New York by causing injury to persons in the state.

“Plaintiff has established that long-arm jurisdiction should be exercised over Neslemur…,” the court concluded.
