Calif. Court Rejects Kelly-Moore’s Efforts to Move Asbestos Case to Oregon

LOS ANGELES –– A California state court has rejected Kelly-Moore’s efforts to move an asbestos complaint to Oregon, accepting the plaintiffs’ position that it could not be accused of forum shopping when it filed a complaint in a state in which the defendant was incorporated and has its principal place of business.

In a notice of ruling filed Oct. 8 in the California Superior Court for Los Angeles County, the parties noted that, one day prior, the court denied Kelly-Moore Paint Company Inc.’s motion to dismiss or, in the alternative, stay based on forum non conveniens.
